Mastercard Faces ACCC Allegations in Federal Court

Mastercard, one of the world’s leading payment processing giants, is currently under scrutiny in Australia’s Federal Court. The proceedings were initiated by the Australian Competition and Consumer Commission (ACCC), who are challenging Mastercard’s business strategy employed from late 2017 to late 2020. Mastercard’s Controversial Strategy

During the period in question, Mastercard sought to establish Strategic Merchant Agreements (SMAs) with numerous major retailers. These agreements typically included debit routing via Mastercard. John Sheehan, the counsel for the ACCC, has been probing Wormald for the past four days, attempting to get him to concede that the strategy was fundamentally targeted at undermining Eftpos, a local payment processing competitor.

Mastercard has found itself on the defensive against accusations from the ACCC. The commission claims that the company’s actions constituted a misuse of its market power. This is due to allegations that Mastercard leveraged its influential position as a credit card provider to reduce or avoid competition in the debit card processing market.

Claims of Dishonesty

During the proceedings, Sheehan has challenged Wormald’s honesty. He suggested that Wormald was not providing honest evidence to the court, an accusation Wormald has refuted. Wormald has also raised eyebrows by claiming he cannot recall certain emails or internal Mastercard documents. He has also claimed to be unaware of the details of key negotiations, even with some of the largest retail brands in Australia.

Mastercard’s Defence

In response to these allegations, Wormald has insisted that Mastercard was pursuing partnerships via these SMAs. The company’s intention, he claims, was to process debit volume, enabling retailers who signed up to SMAs to enjoy the benefits of Mastercard’s data products and other advantages. However, Wormald has also admitted he cannot recall or was not aware of the specifics of proposed SMAs with notable companies such as BP, Myer, McDonalds, 7-Eleven, Officeworks, and others.

The Chemist Warehouse Case

One particular focus of the proceedings has been Mastercard’s dealings with Chemist Warehouse. The chair of Chemist Warehouse, Jack Gance, had decided to process the pharmacy chain’s debit transactions via Eftpos. Sheehan suggested that Wormald and Mastercard were concerned that Gance might express his frustration with Mastercard to the media. This, Sheehan claims, influenced Wormald’s intervention after a disagreement between Chemist Warehouse and Mastercard.

Wormald, however, was unable to recall who initiated a 12-month agreement allowing Chemist Warehouse to route debit transactions to Eftpos. This agreement was made after Wormald had repaired the relationship with Gance. Despite Sheehan’s repeated questioning, Wormald maintained that he could not recall the origins of this unusually short partnership.

Upcoming Proceedings

The cross-examination of Wormald concluded yesterday. Following this, a number of subordinate executives from Mastercard are expected to take the stand. The trial is expected to last for another six weeks.

As the legal proceedings continue, the global payments industry will be watching closely. The outcome of the case could have far-reaching implications for the sector and its practices moving forward.
